8. Project Scope
The scope of any construction project is defined exclusively by the written Project Agreement, plans, specifications, and related documents executed by both parties. Website descriptions of services are general in nature and do not define the scope of any specific project. Changes to project scope after execution of a Project Agreement may require a written change order signed by both parties.
9. Construction Agreements
All construction work performed by Rentfro Construction, Inc. is governed by a written Project Agreement. The Project Agreement controls all aspects of the construction relationship, including scope, price, schedule, payment terms, warranties (if any), dispute resolution, and other terms. In the event of any conflict between these Website Terms and a Project Agreement, the Project Agreement shall control with respect to the construction project.
10. Client Responsibilities
Clients are responsible for providing accurate and complete information regarding the project site, existing conditions, ownership, applicable restrictions, and project requirements. Clients are responsible for obtaining necessary property owner consents and for ensuring the Company has lawful access to the project site. Inaccurate or incomplete information may affect project scope, pricing, and schedule.
11. Site Access
The client is responsible for providing the Company and its subcontractors with reasonable and lawful access to the project site as required for construction operations. Delays or restrictions in site access caused by the client or third parties may affect the project schedule and may constitute a basis for schedule adjustment or additional costs under the Project Agreement.
12. Permits and Approvals
Responsibility for obtaining necessary building permits, approvals, and inspections is as specified in the Project Agreement. The Company does not guarantee that permits will be issued by applicable governmental authorities. Permit requirements, fees, and timelines are outside the Company's control and may affect project schedules and costs.
13. Plans and Specifications
Construction work is performed in accordance with plans and specifications as defined in the Project Agreement. The Company is not responsible for errors or omissions in plans or specifications provided by the client or third parties. Discrepancies, conflicts, or ambiguities in plans or specifications should be identified prior to construction commencement.
14. Change Orders
Changes to the scope of work after execution of a Project Agreement require a written change order signed by both parties before additional work is performed. Change orders may affect project pricing and schedule. Verbal agreements to perform additional work do not create binding obligations unless confirmed in writing.
15. Scheduling
Project schedules are established in the Project Agreement and are subject to adjustment based on weather conditions, permit timelines, material availability, subcontractor schedules, client-caused delays, and other factors. The Company will make reasonable efforts to adhere to agreed schedules but does not guarantee completion by any specific date unless expressly provided in the Project Agreement.
16. Delays
The Company is not responsible for delays caused by factors outside its reasonable control, including but not limited to weather, acts of God, governmental actions, permitting delays, material shortages, labor disputes, or client-caused delays. Such delays may entitle the Company to schedule adjustments and, in some cases, additional compensation as provided in the Project Agreement.
17. Weather and Site Conditions
Construction activities are subject to weather conditions and site conditions that may affect scheduling, methods, and costs. Unforeseen site conditions discovered during construction may require scope adjustments and may affect project pricing. The Company will communicate material changes in conditions to the client as provided in the Project Agreement.
18. Materials
Materials used in construction projects are as specified in the Project Agreement. Material substitutions may be necessary due to availability, manufacturer discontinuation, or other factors and will be handled as provided in the Project Agreement. The Company is not responsible for delays caused by material shortages or supply chain disruptions outside its control.
19. Subcontractors
The Company may engage subcontractors to perform portions of construction work. The Company is responsible for coordinating subcontractor work as part of project management. Subcontractors engaged by the Company work under the Company's direction for the applicable project scope.
20. Safety
The Company maintains safety practices on its construction sites. Safety requirements and responsibilities are addressed in the Project Agreement and applicable law. Clients and their representatives are expected to comply with site safety requirements when present on the project site. The Company does not guarantee the absolute prevention of all accidents or injuries.
21. Quality Control
The Company performs construction work with attention to quality as defined in the Project Agreement. Quality standards are based on applicable industry practices and project specifications. The Company does not provide warranties beyond those expressly stated in the Project Agreement.
22. Inspections
Construction work may be subject to inspections by governmental authorities as required by applicable permits and codes. The Company will cooperate with required inspections. The client is responsible for arranging any third-party inspections not required by applicable law unless otherwise specified in the Project Agreement.
23. Payments
Payment terms are as specified in the Project Agreement. Payments are due as and when specified in the Project Agreement. The Company reserves all rights and remedies available under applicable law in the event of non-payment, including but not limited to suspension of work and assertion of applicable liens.
24. Deposits
Deposits, if required, are as specified in the Project Agreement. Deposits are applied toward project costs as provided in the Project Agreement. Refundability of deposits is governed by the Project Agreement and the Company's Refund Policy.
25. Taxes
Applicable taxes are the responsibility of the party as specified in the Project Agreement and applicable law. The Company is not responsible for providing tax advice. Clients should consult qualified tax advisors regarding the tax treatment of construction costs.
26. Late Payments
Late payments may be subject to interest, fees, or other remedies as specified in the Project Agreement and applicable law. The Company reserves the right to suspend work in the event of non-payment as provided in the Project Agreement.
27. Cancellation
Cancellation of a project after execution of a Project Agreement is governed by the Project Agreement and the Company's Refund Policy. Cancellation may result in charges for work performed, materials ordered, and committed costs. Submission of an inquiry through this Website does not create a Project Agreement and does not give rise to cancellation charges.
28. Suspension
The Company reserves the right to suspend construction operations in the event of non-payment, unsafe site conditions, client breach of the Project Agreement, or other circumstances as provided in the Project Agreement and applicable law.
29. Project Termination
Termination rights and obligations are as specified in the Project Agreement. Termination may result in charges for completed work, committed costs, and applicable damages as provided in the Project Agreement and applicable law.
